Efeitos da judicialização da educação infantil evidenciados na produção acadêmica brasileira (2009-2019)
This study has sought to tackle the issue of the challenges highlighted by the academic production dealing with the judicialization of child education. For such, its purpose was to analyze the judicialization of child education in the academic production found in Graduate Programs in Education in Brazil, concerning the assurance of the right to daycare centers and pre-schools, between 2009 and 2019. It is characterized as qualitative research whose type is the state of knowledge. The results yielded by the study have pointed out that judicialization is a palliative one-off action aimed at resolving the lack of school places since it is not enough to assure the right of some children by means of lawsuits without long-term planning and with no budget available to fulfill the right of all children who need places in early-childhood schools. This impact the very concepts of right and child education arising from the history of Brazilian educational policies, in order to overcome the welfare view and charitable care. It is also appropriate to consider that fulfilling the right to child education still faces daunting challenges such as the priority given to funds for elementary/middle schooling and the lack of quality, arising from the effects of judicialization regarding pedagogical issues, an example of that being overcrowded classrooms and the lack of human and material resources. In this regard, this investigation makes room for new studies on the subject in the Graduate Programs in Education, especially and in the Northeast region of Brazil.
